Terms & Conditions

Company: Legacy Lens Studios LLC (“Legacy Lens”, “Company”, “we”, “us”, or “our”)
Client: The individual or entity receiving services (“Client”, “you”, or “your”)

1. Services Provided
-
Legacy Lens Studios LLC provides customized video production services including filmed interviews, story development, editing, and delivery of completed Legacy Films.
2. Bookings and Payment
-
A 50% non-refundable deposit is required to reserve your filming date.
-
The remaining 50% installment must be paid at least 14 days prior to your reserved filming date to confirm.

If the full installment is not paid at least 14 days prior to the reserved filming date, the reservation hold is released from our schedule and the date is made available to other potential clients. A 10% late fee must be paid by the Client before rescheduling another filming date.

Pricing is subject to change and is confirmed at the time of booking.

Travel fees, location costs, or other third-party expenses will be disclosed in advance and billed accordingly.
3. Cancellation and Rescheduling
-
Changes made by the Client within 14 days of the reserved filming date will incur a 20% fee to reschedule.

Changes made by Legacy Lens within 14 days of the reserve filming date will result in a 20% refund to the Client.

Cancellations by the Client will forfeit the initial 50% deposit. Refusal by the Client to pay the rescheduling fees is considered a cancellation.
4. Creative Control
-
Legacy Lens retains full creative discretion regarding the style and structure of the final product. We welcome collaboration however final editorial decisions rest with the Company.

Minor revision requests (e.g. factual errors, name corrections) are included. Major revisions or structural changes may incur additional fees.
5. Intellectual Property
-
Upon full payment, the Client shall retain full ownership of the final, edited film, including the right to share, store, archive, or distribute the film for personal and family use.

Raw, unedited footage may be made available to the Client upon request and may be subject to an additional archival delivery fee. Ownership of raw footage transfers to the Client upon payment.

Legacy Lens may request permission to use short excerpts for promotional purposes (e.g., portfolio, website), but no content will be publicly shared without explicit written Client consent.
6. Privacy and Confidentiality

All personal stories, interviews, and private family materials shared with Legacy Lens are treated as confidential.

We will not publish, distribute, or disclose any content without your written approval.

The Company agrees to implement appropriate safeguards to protect Client materials, including digital storage protections and secure file delivery.
7. Client Responsibilities
-
The Client agrees to participate in a phone call to discuss the structure of the interview. This generally takes place about 2 weeks prior to the reserved filming date and typically lasts about one hour.

The Client agrees to provide access and permission to film inside their home.
-
The Client agrees to be available on the agreed-upon filming date and communicate any potential scheduling conflicts in a timely manner.
8. Delivery and Storage
-
Legacy Lens will deliver the final Legacy Film in three different formats: an online download link, an archival-quality M-Disc, and 2x USB-C thumb drives. Delivery of these items will constitute a completion of the services rendered.

Legacy Lens will store a copy of the final film for 12 months following delivery. After this period, we may not retain backups unless otherwise agreed.
9. Limitation of Liability

Legacy Lens shall not be held liable for any indirect, incidental, or consequential damages resulting from service performance or use of the final product.

Our total liability under this agreement shall not exceed the amount paid by the Client for the specific services rendered.
10. Force Majeure
-
Legacy Lens is not liable for delays or failure in performance due to events beyond our control, including but not limited to acts of God, illness, injury, accidents, inclement weather, or government restrictions.

In the event of an unexpected delay on the reserved filming day, all good-faith efforts will be made to reschedule as soon as possible.
11. Dispute Resolution

Any disputes arising from this agreement will be first addressed through good-faith negotiation.

If unresolved, the parties agree to submit to mediation or arbitration before seeking litigation.

This agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.
12. Entire Agreement
-
This document constitutes the entire agreement between Legacy Lens and the Client and supersedes any prior communications or understandings, whether oral or written.
13. Modifications
-
Any modifications to this Agreement must be in writing and signed by both parties.

By submitting payment electronically, the Client affirms that they have read, understood, and agreed to these Terms and Conditions.
